Judge Levett said Banks suffered from a number of disadvantages, including learning difficulties and mental health problems and had been described as “a boy in a man’s body.”He said he was not able to reach a conclusion about what sexual offence Banks had intended to commit as there was a significant gap between him trespassing and any likely contact with the occupant of the house.
He added Banks had not reoffended during the last 18 months and was now living in accommodation in Stanford-le-Hope, south Essex.
Sentence was adjourned until yesterday when Judge Martyn Levett said he doubted if Banks would have committed the offence if he had not been watching Grand Theft Auto.“I can’t say any responsibility is born by those who make these films and videos and market them, but steps should be taken to prevent them falling into the hands of people who might try to replicate them,” he said.
He said the public should be aware of the prevalence of cases of vulnerable and impressionable people being affected by playing video games or watching films depicting gang violence and rape.
